Big Surprise; Steven Avery will enter not guilty pleas Tuesday to charges in Halbach Murder

To the absolute surprise to know one, Steven Avery will likely enter “not guilty” pleas to charges he abducted and murdered Teresa Halbach this Tuesday in court. Steven Avery is charged with first-degree intentional homicide, mutilation of a corpse and possession of firearms by a convicted felon.

Avery’s attorneys plan ask that his $500,000 cash bond be reduced when they make a brief appearance in a morning session before Manitowoc County Circuit Court Judge Patrick Willis.

Willis, who last month ordered Avery to stand trial on charges related to the Oct. 31 disappearance of Halbach, a 25-year-old freelance photographer from Calumet County, will also set schedules for motions, pretrial hearings and conferences and a trial.

It is expected that defense attorneys for Avery will consider asking for a change of venue because publicity influencing a jury pool. Unless the venue is changed to the moon, it will not matter in this most heinous crime with DNA evidence.

Avery’s attorneys, assistant state public defenders Erik Loy and Craig Johnson, have not commented on the case since Avery’s preliminary hearing, except to say not guilty pleas would be entered.

But Loy has said the defense team will consider asking for a change of venue because publicity may have influenced the jury pool.

Calumet County Dist. Atty. Ken Kratz, the special prosecutor, also has declined comment.

Theories Abound in Halbach Murder. Did Steven Avery have Help?

Theories are still swirling about the Teresa Halbach murder a day after a Manitowoc County judge decided Steven Avery should stand trial for the crime. The question on every one’s mind is whether Steven Avery had help or not in th murder and cover up of the crime?

Mishicot is just a few miles east of Avery’s home. Shirley Brose lives nearby, and says she can’t go anywhere without people talking about the Avery case. She echoes, “‘Do you think so-and-so-did it?’ ‘Do you think one of their relatives did it?’ ‘Do you think a relative was involved?’”

The many theories and rumors that are in the air is that the police may not have uncovered the complete story of what transpired and that Steven Avery had help.

Despite the evidence laid out and the fact Avery is headed for trial, a lot of people in Mishicot say they don’t feel police have uncovered the real story of what happened on the Avery family property.

“I definitely think he had help,” Jeff Huycke expressed, saying the case is “very close to home, and it’s not good.”

Like in most of these cases, the evidence points toward one individual. Now the prosecutors just need to prove the case and there appears to be a mountain of evidence against Avery.

And like in all cases, Defense Attorneys: Avery To Plead Not Guilty.

Defense lawyers say that the man accused of killing missing photographer Teresa Halbach will plead not guilty when he returns to court for his arraignment on Jan. 17.

Steven Avery, 43, was ordered to stand trial on Tuesday on charges that he killed Halbach at the Avery family’s auto salvage yard near Mishicot and got rid of the body by burning it.

Avery has contended that he’s being set up because of the $36-million lawsuit that he filed against Manitowoc County for being wrongly convicted in a 1985 rape case. After serving 18 years, he was freed from prison two years ago after DNA evidence showed that he didn’t commit the rape.

For the first time we see verification from the crime labs that the remains and DNA material that was discovered at the Avery Salvage Yard property was in fact that of Teresa Halbach.

Now, the DNA evidence described in court Tuesday showed bone fragments found in a burn pit on the Avery property were consistent with Halbach’s genetic material.

Sherry Culane, a DNA analyst with the state crime laboratory, said that that profile could be found in only one out of 1 billion white people.

The FBI is doing more DNA testing of the remains to come up with a positive identification.

Update: Family Files Death Certificate

The Halbach’s family has filed her death certificate with the Manitowoc County register of deeds.

The certificate notes that her body wasn’t found but lists the place of death as the address of the salvage yard on Avery Road in the town of Gibson.

Steven Avery Says Teresa Halbach May Still Be Alive

So now Steven Avery plans on playing games with the Halbach family by making wild claims that Teresa Halbach may still be alive. Avery

Steven Avery said he thinks the 25-year-old photographer he’s accused of killing may still be alive.

In another jail house interview, Avery said Teresa Halbach, “Could still be out there.”

Avery claims the case against him is all a set-up.

If this was not so cruel it might be comical. It is instead just hideous. Now the Avery family is setting up a defense fund. Who is their right mind would give to this?

Avery’s family is setting up a defense fund for him. “It will go toward Steven no matter what, 100 percent,” said niece Carla Avery.

“It will be used for cash bail or defense. We are looking into regular attorneys instead of public defenders.”

AP NewsBreak: Avery thinks Halbach may be alive

Instead of just doing the right thing we see where Steven Avery is going with his pseudo-insane act.

“Any person who would have killed Teresa Halbach “ain’t got a right mind,” Avery said. “There is no way I could kill somebody,” he said. “That would be too hard.”

Avery’s Family Stand Behind Him

A day after Steven Avery speaks out from jail, his family echos Steven’s assertion that Teresa Halbach may still be alive.

Dolores Avery, Steven’s mother starts the conversation by claiming her son’s innocence.

Steven Avery’s mother and niece, Carla, are quick to proclaim Steven’s innocence and although they are not quick to admit it, they are taking steps to try to prove he had nothing to do with Teresa Halbach’s disappearance or murder.

It seems to run in the family as Carla Avery, Steven’s niece, went on to say that for all she knew the bone fragments could be sheep bones even though the “State crime lab tests show the bone fragments were that of an adult female and that teeth found were human”.

Steven Avery charged in the death of missing woman, Teresa Halbach

Steve Avery was was charged Tuesday with killing and mutilating a freelance photographer, Teresa Halbach, who had an appointment with him the last day she was seen. According to authorities, the gruesome findings by searchers of the Avery Salvage property yielded human teeth and bones in a burn pit behind Steven Avery’s garage.

Preliminary results Tuesday identified the remains as Halbach’s, according to a criminal complaint charging Avery with first-degree intentional homicide and mutilation of a corpse.

Authorities believe the charred remains are all that’s left of the 25-year-old Calumet County woman, who vanished Oct. 31 after going to the Avery family’s auto salvage business to photograph a minivan for sale for Auto Trader Magazine. Halbach’s family members later found her sport utility vehicle at the salvage yard.

Steven Avery appeared before the County Circuit Court where bail was set in the amount of $500,000 and the homicide charge carries a mandatory life in prison sentence.

Avery appeared in Manitowoc County Circuit Court on Tuesday, when Judge Patrick Willis set bail at $500,000 cash and scheduled a preliminary hearing for Dec. 6 on the homicide and mutilation charges.

Avery, dressed in black-and-white prison clothes, looked straight ahead and said nothing during the 12-minute hearing, which did not cover the weapons charge. The judge set a tentative status conference Monday on that case.

The homicide charge carries a mandatory life in prison sentence, while the mutilation charge carries up to 12 1/2 years in prison and $25,000 in fines. Wisconsin does not have the death penalty.

Avery has repeatedly told reporters he believes he is being set up because of his pending $36 million lawsuit against Manitowoc County for his wrongful conviction.

As Steven Avery proclaims his innocence and states he was set up as his blood was found in Teresa Halbach’s vehicle, Avery’s family also acts just as strangely and are in a world of denial. The Avery Salvage Yard is open for business and the family is just going to throw themselves in to work. After what just occurred there?

Steven Avery’s father and brother threw themselves into their work, trying to get caught up after losing a weeks worth of business.

Steven Avery’s father, Allen, talked of his frustration and anger from inside his business office.

“All I can tell you is that it did not happen on Avery property. That’s if it happened and I don’t believe it happened.”

The idea that all this gruesome evidence that was found on the Avery property was planted as Steven Avery states is simply appalling. However, what else would one think he would say trying to capitalize on his previous improper incarceration.

Teresa Marie Halbach’s SUV found near Avery yard

According to The Green Bay Press Gazette, the SUV vehicle of the missing Teresa Marie Halbach was found on Saturday in a gravel pit near the auto salvage yard operated by Steven Avery.

Searchers Saturday found the vehicle of a missing 25-year-old St. John woman in a rural gravel pit near an auto salvage yard operated by a man convicted of a 1985 sexual assault and exonerated by DNA evidence 18 years later, according to Manitowoc County Sheriff Ken Petersen. The auto salvage yard is owned by Steven Avery’s family.

Steven Avery, whose family owns the salvage yard, told the Herald Times Reporter late Saturday that he has “no idea” what happened to free-lance photographer Teresa Marie Halbach.

“I don’t know what happened to her,” he said in a telephone interview from his father’s vacation property near Crivitz. “That’s the honest to God truth. I just wish they’d find her, so we’d know what really happened.”

Avery commented as officers scoured his property between Mishicot and Maribel, where Halbach’s dark green 1999 Toyota Rav4 was found. Petersen said the presence of investigators on Avery’s property could be a “coincidence.”

Steven Avery denied knowing how Teresa Marie Halbach’s vehicle got into the “pit”.

Avery said he last saw the missing woman driving away from his rural property on Monday afternoon, after she had taken photos of one of his vehicles for Auto Trader magazine.

Avery denied knowing how Halbach’s vehicle got into what he called “the pit,” a storage area for junk vehicles used in his family’s salvage business. Avery said he hasn’t been in the pit “in quite a while.”Halbach has been to his home about 15 times in the last year to take photos of his vehicles for Auto Trader, Avery said.

“It was always just ‘hi, how ya’ doing,’ that kind of thing,” Avery said. “It was just business.”

Teresa Marie Halbach’s Disappearance Called Suspicious

Numerous searches on land and in the air are underway in the disappearance of Teresa Marie Halbach. She was last seen Monday afternoon in Manitowoc.

An aerial search was underway for the land from Manitowoc to Green Bay hoping to locate her car, which they say is a major key to their investigation.

Dozens of relative and friends spread throughout Northeast Wisconsin to distribute Missing Person posters with Teresa’s picture and description. They hope someone in a six-county area has seen her.

According to WBAY2, Teresa Marie Halbach last stop was at the home of Steven Avery.

Coincidentally, Halbach’s last stop Monday was at Steven Avery’s home. He’s the man who spent 18 years in prison for crimes he didn’t commit — attempted murder and sexual assault — until DNA testing cleared him.

The sheriff says the Mishicot area remains a focal point of the investigation. “This is the last place she is seen alive and seen by somebody, and of course we’re going to be concerned, interested in that area.”

According to The Manitowoc Herald Times Reporter, Teresa Marie Halbach’s appointment was to photograph a van being sold by Steven Avery.

Green Bay television stations reported Friday night that the appointment was to photograph a van being sold by Steven Avery. Avery is the Two Rivers man who was wrongly convicted for a 1985 sexual assault and spent years in prison before being exonerated by DNA evidence in 2003.

Avery told WFRV-TV that Halbach took a photo of his van and left.

“I said she was out here no more than five minutes,” Avery was quoted as saying on the station’s Web site. “(Investigators) came in and looked around and they left. I don’t know if I’m a suspect but as long as I can help, I’ll help.”

Officials were trying to determine if she had any appointments after that, and if she showed up for them.

Sheriff says Steven Avery may be among last to see missing woman
