It’s about time a judge stood up for the rule of law and treated the Lafave case for what it was. As soon as the original plea deal was announced most everyone shook their head and said the sentence was too light. It immediately set off a firestorm and criticism of a double standard that “kept the attractive, young media darling out of prison”.A Marion County Judge rejected the plea deal. Debra Lafave faces similar charges in Marion County as she did in Hillsborough County because one of the alleged sexual incidents took place there.
A judge in Marion County, Florida, on Thursday rejected a proposed plea deal for Debra Lafave, who pleaded guilty in another county to having sex with a 14-year-old student while she was a teacher.
“The agreement went below the guidelines, and I’m not willing to go below the guidelines,” Judge Hale Stancil told CNN, without elaborating.
The trial in Marion County for the 25-year-old former reading teacher is set for April 10.
Defense attorneys had sought to spare their client a prison sentence, which they were able to do with the plea agreement in Hillsborough County. Lafave pleaded guilty there on November 22 to two counts of lewd and lascivious behavior.
ABC Action News: In surprise move, Marion County judge rejects Lafave plea deal
It looks like the plea deal that kept Debra Lafave out of prison was too good to be true after all.
Thursday afternoon, a judge in Marion County rejected the plea arrangement that had previously looked like a done deal in Hillsborough County, meaning the former teacher will be going to trial next spring on charges of sexual battery.
“The court is not going to, at this time, accept the plea that has been presented,” Judge Hale Stancel stated.
With what was expected to be a stamp of approval from the Marion County Judge turned out to be far from it today in court.
Based on that last allegation, Lafave faced charges in both Hillsborough and Marion counties. Her November plea deal with prosecutors in Hillsborough — which left her with three years of house arrest, seven years of probation, and status as a sex offender — was said to include the Marion County charges. The judge’s stamp of approval was expected to be a formality today, but he rejected the deal and set an April trial date.
“There were some unexpected developments today in court. I really don’t want to comment on those developments. I anticipate that we will be here in the next couple of weeks,” John Fitzgibbons said. Prosecutors even seemed surprised by the turn of events.
Judging from the glare on Debra Lafave’s mothers face and attorney’s reaction, someone has some explaining to do. A defendant agreeing to a plea deal that is supposed to encompass both county’s charges, only to have it fall through. Someone did not dot the i’s and cross the t’s. Ouch. The trial is expected to go forward in Marion, despite the wishes of the victim’s family.
Tampa Bay News 10: LaFave’s attorney reacts to plea rejection
Attorney John Fitzgibbons says Debra Lafave was obviously upset by the events in court on Thursday. Fitzgibbons says that was clear from the tears in her eyes. LaFave’s mother also appeared to be moved to tears because of the judge’s decision.
Fitzgibbons told me the events were “not a total surprise.” Fitzgibbons says after practicing law for several years, he never counts on a judge going along with a plea agreement until it is signed, sealed and delivered. Now Debra Lafave finds herself between the proverbial rock.
“If it goes to trial, Debbie can withdraw her plea in Hillsborough”
However that is not likely to happen, because it would be a huge gamble that the insanity plea would work. LaFave also isn’t facing any jail time in Hillsborough. Meantime while the judge has jurisdiction over the case, “the Marion state attorney could end the case by dropping all the charges”
That too isn’t likely, because the state attorney has to stand for re-election. That could be political suicide if the charges are dropped, even though the state attorney was not pleased with the judge’s decision.

An Amber Alert issued for Teketria Buggs, 12, Sunday and remained in effect in southeast Texas. She was last seen asleep on her couch at her home in the 9000 block of Johnson Road in Orchard late Friday night.
Teketria known by friends as Teeky Bugg, was last seen asleep on a couch at her home in the 9000 block of Johnson Road in Orchard late Friday night. She was reported missing at about 10 a.m. Saturday. None of her belongings, including a jacket, had been taken from the home.
On Monday night, Teketria’s mother told CNN’s Nancy Grace that she thinks someone Teketria trusted might have taken her.
Texas EquuSearch and the Fort Bend County Sheriff’s Department widened their search Tuesday morning near Teketria’s rural home and asked for help from the Texas Department of Transportation.
“They are going to help us, being guides. They know the ditches, and the bridges and the culverts,” EquuSearch founder Tim Miller told KPRC Local 2.
Tim Miller of Texas Equusearch also went on to describe the many search methods that they would have at their disposal to search for Teketria Buggs.
Dive teams searched the Brazos river Tuesday afternoon. Miller said divers are searching several areas of the water where sonar equipment detected something. Miller said searchers would use remote control airplanes, high-vision scopes, 4-wheelers and Sonar to search more than 12 acres of heavily wooded land and the Brazos River near her home.
“I don’t see where there is to go. We understand she’s scared to death of the dog. She won’t even go to her aunt’s house, which is right next door, when it was dark. So for her to take off and go to some place on her own, I think that’s out of the question,” EquuSearch founder Tim Miller told KPRC Local 2.
Description: Teketria is a black female, about 4 feet 10 inches tall and weighs about 95 pounds. She has black hair, brown eyes, and light brown skin. She was last seen wearing a red and white long-sleeved pullover shirt, blue jeans and white tennis shoes.
Anyone with information should call the Fort Bend County Sheriff?s Office at (281) 341-4665 or Fort Bend County Crime Stoppers at (281) 342-TIPS.
Fort Bend Herald: Search for missing girl expands
The search for 12-year-old Teketria Buggs, who disappeared in Orchard Saturday evening, continued Tuesday morning with additional personnel joining the search.
A prayer vigil for Buggs will be held at 7 p.m. Wednesday, Dec. 7, at of the Pilgrim Journey Baptist Church, 2022 Ransom Road in Richmond, where Buggs is a member. Deacon Robert Willis will conduct the service, which is open to the public.
Search for missing girl focused on Brazos River
Video
The search for a missing Fort Bend County girl moved to the water Tuesday as dive teams went in into the Brazos River.
Tuesday was an especially emotional day for the searchers and volunteers.
Although the town of Orchard has a population of only 400, they have big hearts. Letters from the girl’s schoolmates, thanking searchers for their efforts, inspired investigators and searchers.
Several veteran deputies wiped away tears as they read the letters posted on the board by volunteers.
Searchers continued to search on land and in the water.
Investigators said they didn’t have any new leads, but divers were concentrating on one area of the river. They said sonar had picked up some images Monday.
The river is about a mile from Buggs’ home, where she was last seen sleeping on her couch.
“It’s been successful in the past. We’ve done many, many dives where it ended up that it was an old barrel or something like that,” said Tim Miller of EquuSearch.
Volunteers came back again to continue the ground search on horseback and four-wheelers.

The Taylor Behl Task Force Monday released photos of a pond, obtained in the investigation, and is seeking public assistance in determining its location. They are requesting your help in determining the location of this picture.
Photos and the request for public assistance were initially sent primarily to news media in the Virginia tidewater area on the presumption that the pond is likely located in that part of Virginia, according to authorities. Other news media, however, have picked up on the information in the highly-publicized case.
The Task Force did not identify the source of the pond photos. Attorney General’s Office investigator, Les Lauziere, when queried Monday by the Vienna Times, would not say whether the photos were taken from a computer belonging to Ben Fawley, “a person of interest” in the case, currently being held by Richmond police on unrelated child pornography charges.
UPDATE: AP: Pond identified as Behl murder investigation continues
Police looking into the death of college student Taylor Behl say they have identified and located a pond shown in two photographs that are part of their investigation.
Sergeant D.S. Carr with the Virginia State Police said in an e-mail to reporters Monday that the pond has been identified located in an area adjacent to Mathews County , but he cannot say anything else about it because of a judge’s gag order in the case.
Other agencies on the task force include the state attorney general’s office, the FBI, and the Richmond and VCU police departments.
Anyone with information should call police at (877) 244-HELP or (804) 828-1196.
Richmond Times Dispatch: Behl investigators want help
Authorities hoping public can lead them to photographed pond
Two photos of a pond believed to be in Mathews County could prove to be little more than a fishing expedition in the hunt for evidence in the death of Virginia Commonwealth University student Taylor Behl. Sources close to the investigation said Behl task force members gathering evidence on the Vienna teen’s death in September — allegedly during a sexual encounter in Mathews with suspect Benjamin Fawley — have no direct evidence suggesting that the pond is linked to Behl’s death.
Still, the sources said investigators want to know where the pond is because it is one of the few places photographed by Fawley that they have not been able to identify and search in the three months since Behl was last seen alive.

Adre-Anna Jackson disappeared Friday after she left her apartment to walk to school. Police state that they called off the search on Saturday, even though her location was still unknown.
Lakewood Police on Saturday called off their search for a 10-year-old girl missing since Friday, even though her location was still unknown.
Adre-Anna Jackson disappeared Friday after she left her apartment for a five-minute walk to Tillicum Elementary. Her family said they didn’t realize she was missing until late Friday afternoon because they didn’t know the school was closed because of snow.
On Saturday, Lakewood Police searched the girl’s apartment, as well as nearby American Lake for clues to Adre-Anna’s disappearance.
“We haven’t given up hope,” Hall told The News Tribune Saturday night. “But we have searched all logical and available places where this young girl could have gone. “Right now we don’t have a whole lot,” Hall said. “But we’re going to continue interviewing and re-interviewing people to make sure we don’t miss anything.”
Adre-Anna’s disappearance is being treated as a missing person’s investigation
Her mother said the fourth grader was carrying a black and pink backpack. She was wearing blue jeans, possibly a blue shirt and white tennis shoes. She’s just under 5 feet tall and weighs approximately 78 pounds. She has brown hair with reddish highlights. She may have been wearing a puffy black coat or jacket.
The News Tribune: Police halt search for Tillicum girl
The girl, described as artistic and well-spoken, disappeared Friday after she left her apartment to walk to Tillicum Elementary a few blocks from her home. But due to the snow, the school had closed that day. Family members said they didn’t realize the girl was missing until late Friday afternoon. They called the police.
The fourth-grader was last seen walking from her family’s apartment off Wads-worth Street Southwest toward Tillicum Elementary, about a five-minute stroll away. Standing outside the police command center in the Tillicum Elementary parking lot Saturday, Hall said there’s been no indication yet that Adre-Anna had been a victim of violence or been snatched by a stranger.
Police, family and rescue workers have “knocked on almost every door in Tillicum,” as well as searched the nearby American Lake and parks. Some even crossed Interstate 5 on the neighborhood’s eastern border to look in that area. Still, no sign of the girl.
Bloodhounds were brought in to find the girl’s scent, but didn’t find a trail, while divers searched American Lake without finding any clues.

Maurice Wallace, a 27 year old man, is being charged with three counts of first degree murder and two counts of concealing a homicide and theft of a motor vehicle in the death of Olamide Adeyooye.
BLOOMINGTON — A 27-year-old man will be charged today with murder in the death of 21-year-old student Olamide Adeyooye.
“Maurice Wallace is today being charged with three counts of first-degree murder, two counts of concealing a homicide and theft of a motor vehicle,” McLean County State’s Attorney Bill Yoder said. “The investigation is ongoing, and additional counts could be forthcoming at a later date.”
(full story)
According to reports (AP), Olamide Adeyooye, was murdered in her apartment and then driven to Mississippi where her body was later found in a burned chicken coop.
But according to court papers, the woman was killed in her apartment on the day she was last seen. Wallace tried to clean blood from the floor of her apartment, then put her body in her car and left the area, the court papers said.
Adeyooye’s badly burned body was found Oct. 21 in Mississippi when the chicken coop’s owner was cleaning up from a fire four days earlier. She was later identified through dental records.
Authorities said two autopsies failed to pinpoint the cause of death, but they will seek another autopsy and further forensic tests.
The slain woman’s father welcomed the charges. “He should pay for it,” Abiodun Adeyooye said in a telephone interview from his home in Maryland.

Suspect was banned from campus
In an unusual move, Illinois State University officials considered the man named as a suspect in Olamide Adeyooye’s death to be a threat and banned him from campus two months before she died.
Police officers handed a letter Aug. 17 to Maurice L. Wallace, 27, who was not an ISU student, that said he was not welcome on campus.
The letter from Helen Mamarchev, vice president of student affairs, followed reports in the last five years that Wallace was kicked out of several buildings, banned from specific areas of campus and accused of theft and harassment on separate occasions. ‘
“I am taking this action based on serious allegations pending against you that suggest that your presence on this campus constitutes a threat to the members of the Illinois State University community,” Mamarchev’s letter says.
The letter adds if Wallace is found on ISU property, he’d be “subject to arrest for criminal trespass.” No such charge has been filed against Wallace since the letter was written.
The AP also added that Wallace briefly worked at the university but was banned from campus for inappropriate conduct.
Wallace, who worked briefly at the university as a food service worker several years ago, was banned from the campus in August, university spokesman Jay Groves said.
Wallace allegedly made inappropriate sexual comments to students and employees, Groves said. He was banned from the campus recreation center in 2001 because of similar incidents.
NBC5: Murder Charges Announced In Student’s Death
Police had named Wallace as a suspect last month in Adeyooye’s disappearance and death. Her body was found Oct. 21 in Mississippi when the chicken coop’s owner was cleaning up rubble from a fire four days earlier. She was later identified through dental records.
Wallace, who lived in the same block as Adeyooye, has been in custody since Oct. 20, when he was arrested at an Atlanta shopping center on an unrelated warrant from Normal. Adeyooye’s car was found abandoned in Atlanta on Oct. 30. Wallace waived extradition from Georgia and has been held in the McLean County Jail in lieu of $540,000 bond on the unrelated theft, aggravated battery and disorderly conduct charges.
ISU officials say they will confer Adeyooye’s degree and present it to her parents.

Joseph Smith who was convicted of raping and killing 11-year-old Carlie Brucia. There is honestly no punishment, live in prison or the death penalty, that fits the crime that this man did. There is no punishment severe enough to make this man pay for the crime that he committed.
(CNN) — In a 10-2 vote, a Florida jury recommended Thursday that Joseph P. Smith should be put to death for the rape and murder of an 11-year-old girl.
Prosecutor Debra Riva argued that Smith should receive the death penalty for the killing of Carlie Brucia, who Smith kidnapped from a car wash parking lot on February 1, 2004, as the youngster was walking home from a friend’s house.
Smith, 39, was convicted November 17 of kidnapping, first-degree murder and sexual battery. It took the jury five hours to return the verdicts. Fox News: Jury Recommends Death Penalty for Killer of Carlie Brucia
SARASOTA, Fla. — After deliberating into the evening, jurors were ready to deliver their sentencing recommendation of the death penalty or life in prison without parole for a mechanic convicted of kidnapping, raping and killing 11-year-old Carlie Brucia.
“The advisory sentence on a majority vote of 10-2 recommends the court impose the death penalty upon the defendant. So say we all this 1st of December,” said the court clerk as she read the jury’s decision.
(AP): Jurors: Death for Fla. Girl’s Killer
Circuit Judge Andrew Owens ultimately will issue the sentence and could do so as early as next month. Under the law, he must give great weight to the jury’s decision before imposing a sentence of death or life in prison without parole.
Smith, 39, showed no reaction as the recommendation was read. Carlie’s mother, Susan Schorpen, let out deep sobs and hugged relatives. Patricia Davis, Smith’s mother, left the courtroom crying.
“I’m overwhelmed. Yes, it’s what I wanted,” Schorpen said. “He may be condemned, but he’s still breathing, and my daughter is not.”

So now Steven Avery plans on playing games with the Halbach family by making wild claims that Teresa Halbach may still be alive.
Steven Avery said he thinks the 25-year-old photographer he’s accused of killing may still be alive.
In another jail house interview, Avery said Teresa Halbach, “Could still be out there.”
Avery claims the case against him is all a set-up.
If this was not so cruel it might be comical. It is instead just hideous. Now the Avery family is setting up a defense fund. Who is their right mind would give to this?
Avery’s family is setting up a defense fund for him. “It will go toward Steven no matter what, 100 percent,” said niece Carla Avery.
“It will be used for cash bail or defense. We are looking into regular attorneys instead of public defenders.”
AP NewsBreak: Avery thinks Halbach may be alive
Instead of just doing the right thing we see where Steven Avery is going with his pseudo-insane act.
“Any person who would have killed Teresa Halbach “ain’t got a right mind,” Avery said. “There is no way I could kill somebody,” he said. “That would be too hard.”
Avery’s Family Stand Behind Him
A day after Steven Avery speaks out from jail, his family echos Steven’s assertion that Teresa Halbach may still be alive.
Dolores Avery, Steven’s mother starts the conversation by claiming her son’s innocence.
Steven Avery’s mother and niece, Carla, are quick to proclaim Steven’s innocence and although they are not quick to admit it, they are taking steps to try to prove he had nothing to do with Teresa Halbach’s disappearance or murder.
It seems to run in the family as Carla Avery, Steven’s niece, went on to say that for all she knew the bone fragments could be sheep bones even though the “State crime lab tests show the bone fragments were that of an adult female and that teeth found were human”.
