One day after the voters, “WE THE PEOPLE”, of California passed Proposition 83 on a 70.5% to 29.5% in Tuesday’s election, US District Judge Susan Illston blocked the law. She stated, “the measure is overly punitive and prevented it from going into effect.”
Voters passed Proposition 83 on a 70.5 percent to 29.5 percent vote in Tuesday’s election. The measure bars registered sex offenders from living within 2,000 feet of schools and parks, a requirement challenged in a lawsuit by an anonymous plaintiff convicted of a sex offense 15 years ago. Ever think elections do not matter? Guess who appointed US District Judge Susan Illston?
Once again, Liberal judges defending sex offenders over our children. If its not bad enough we have judges not sentencing sex offenders to jail time because they are too short or only giving convicted sex offender mere months, we now have judges blocking laws that would protect children. Instead we have judges that think the answer is to have convicted sex offenders wear t-shirts that state, “I am a sex offender”. What the hell is this country coming to?
Judicial legislation is out of control and must be stopped. By an overwhelming 70.5% this proposition passes in CA. It is not as though California is a conservative, red state. Even the common sense voters of California know that they must protect themselves and their children from sexual predators. Its too bad the liberal judges wish to protect the sex offender.
It is amazing how the democratic process in this country is constantly undermined by judges with an agenda. The response from Governor Arnold Schwarzenegger’s legal affairs secretary was as follows:
“The voters have spoken and the governor will vigorously defend the lawsuit so the implementation of this vital measure can go forward to protect Californians against the lewd acts of convicted felons,” Hoch said in a statement.
This judicial activism and interference has got to end. This has nothing to do with politics and a Republican or Democratic issue. This is about our children … something that all of us can agree on his a common ideal, “We the People” can all stand for.

A man who had sexually molested a preschool girl and broadcast the images live over the internet has been arrested. The depravity of some people defies words. Luckily for this young girl, this pedophile sent the images to and undercover detective. The young girl was rescued 2 hours after Toronto police’s Sex Crimes child exploitation unit witnessed the live assault.
He alerted police in St. Thomas, a city in southwestern Ontario where police believed the man lived, and they were able to track him down in two hours.
“To see this child and look that child in the eyes and realize that the child was live somewhere, being abused, we had to save the child right then,” Krawczyk said at a news conference. “The minute we realized what was happening, we went as fast as we could.”
Krawczyk belongs to Toronto’s Child Exploitation Section, acclaimed for its work tracking down child pornographers on the Internet. Microsoft Corp. teamed with the detectives last year to launch a software program designed to help police forces around the world hunt down child porn Internet traffickers.

Using CETS, police agencies can manage and analyze huge volumes of information in powerful new ways, such as cross-referencing obscure data relationships and using social-network analysis to identify communities of offenders.
“CETS has helped police catch up with cyber-criminals on the Internet,” Gillespie says. “The product has exceeded my wildest dreams. I have also been impressed by Microsoft Canada and their passion to do the right thing. I am overwhelmed with their sense of responsibility”. (Microsoft.com)
The man’s name has not yet been released to protect the identity of the preschool girl. It has not been reported what the relationship is between the arrested pedophile and the girl.
He said the identity of the 34-year-old man was not being released to protect the girl. He declined to say whether the suspect was related to her.
Krawczyk said the girl was safe with family members and getting medical care.
The man’s bail hearing was set for Tuesday and he faces 10 charges of sexual assault and the production, possession and distribution of child pornography. (WNBC)
The unidentified man will be charged with an array of sex charges that will hopefully put this dirt bag away for quite a while.
Ontario law enforcement agencies yesterday revealed how they tracked down and arrested the 34-year-old man, who faces a litany of charges including making child pornography, sexual assault and sexual interference. (Canada.com)
The Toronto Child Exploitation unit has done some amazing work including helping Florida police locate a young girl who had appeared in a series of sexually explicit photographs taken at a Walt Disney World hotel. There message is very clear and very much appreciated.
“The message to all pedophiles, and people who want to sexually exploit children on the Internet is that we are on the Internet 24/7, we know where you are and we will find you,” Krawczyk said.

Do you ever wonder whether sex offenders live near you? Do you ever wonder whether they are at colleges and universities that your children attend? ABC News 13 in Texas decided to find out that very question and the answers were shocking. Doesn’t this give one a safe feeling? There comes a point in time where law abiding citizens rights have to be given greater latitude than those that are criminals. especially sex offenders. To continue to put sex offender in an environment that is a “target rich environment” is just asking for problems.
Of course every university or college is going to proclaim their safety. However, we have learned over the years the repetitive rate of sex offenders is high and that in many cases they are not caught on the 1st, 2nd or 20th offense. Colleges can increase all the securities measures they wish, the problem is they are not getting rid of the source. The sex offender will act again, no matter what the lighting is like on campus, its only a matter of time.

Read the letter from the University of Houston’s President and ask yourself if that makes one feel at ease.

You know sometimes you think you have seen and heard it all. Then you get a story like this one out of South Carolina. 23 year old Bryan Garcia was given a 20 year prison sentence and ordered to register as a sex offender after Garcia was found guilty of trying to dig up the grave of a 12 year old girl to have sex with her.
Bryan Nicholas Garcia never did find the girl’s grave and told investigators he wanted to “take her home and have fun,” Clover Police Lt. Randall Horn said.
Garcia pleaded guilty but mentally ill Wednesday to two charges of destruction of a graveyard. Circuit Judge John Hayes sentenced Garcia to 20 years in prison and ordered him to register as a sex offender.
Two mental evaluations found Garcia has a chemical imbalance in his brain that makes him want to have sex with corpses and children, defense attorney John Rhea said. (The State)
Sometimes some of the crimes people commit or intend to commit defy speech. Not only should thins individual never walk among us, he should never walk among anyone. I mean, Bryan Garcia attempts to dig up a 12 year old girl’s grave because he saw her picture in her obituary and thought she was cute. Garcia then tells police he wanted to “take her home and have fun.”
Get this, Bryan Garcia was a former National Merit Scholar at York High School.

PARENTS BEWARE … It appears that a man has attempted to lure young girls into his pickup in both Pineville and Mount Holly County, NC. The driver is said to be a white male driving a red pick up. It is said that he offered them candy Luckily in both cases, the girls ages 11, 13, 10 and 11 refused the ride and reported the incident to family members.
Police in Mount Holly say two girls reported being approached by a man in a pickup truck Monday and asked if they wanted to ride with him. The girls, ages 11 and 13, tell police the driver offered them candy.
It sounds similar to a case last week in Pineville, where two girls — ages 10 and 11 — told police that a white man with a mustache in a red pickup truck offered them candy if they would take a ride with him. That truck had silver flames on the side, the girls said.
Description:
- The driver was reported to be in a red pickup truck.
- He was described as a white man with a mustache.
- The children in the Mount Holly case did not mention the silver flames in their description of the truck. (Charlotte Observer)

Former school teacher, 25 year old Janelle Marie Bird who had previously been found guilty of “two counts of unlawful sexual activity with a minor and two lesser counts of unnatural and lascivious act” was sentenced to two years in prison. Seems like a much different sentence than also convicted teacher, Debra LaFave
Bird admitted having a relationship with a 15-year-old boy at East Hill Christian School. Both testified during the trial that they loved each other.
Defense attorney Jerry Allred had asked that Bird be placed on probation and serve no time in prison. A telephone message left at his office after business hours was not returned.
As a result of her conviction, Bird must register as a sex offender with local authorities wherever she lives for the rest of her life. (AP)
