A prominent 48 year old attorney Philip Russell has been charged with obstructing justice and destroying evidence in the Robert F. Tate/Christ Church of Greenwich, CT child porn scandal.
NEW HAVEN, Conn. (AP) A prominent defense attorney was accused of destroying a computer containing child pornography that belonged to his client, a former church music director, according to an indictment unsealed Friday.
Philip Russell has pleaded not guilty to the charges; however, the indictments reads as follows. Russell faces up to 20 years in prison and a fine of up to $250,000 on each count.
The indictment says Russell destroyed a laptop computer Oct. 9 containing child pornography that was owned by Robert F. Tate, the former music director at Christ Church in Greenwich, where the former President George H.W. Bush once worshipped.Tate pleaded guilty in January to possessing child pornography.
A church employee discovered images of naked boys on Oct. 7 while using Tate’s computer, according to the indictment. A day later, church officials sealed and wrapped Tate’s laptop, treating it as evidence, authorities said.
Russell took Tate’s computer and, after learning it contained images of naked boys, “altered, destroyed, mutilated and concealed it by taking it apart,” according to the indictment.

Church officials sealed and wrapped Tate’s laptop, treating it as evidence, according to the indictment. But on Oct. 9, Russell took the computer, the indictment alleges.
Also on Oct. 9 church officials and Russell allowed Tate to pack a bag, in which he put some of the child pornography and discarded the bag, according to the indictment.
Tate resigned and Russell and church officials arranged for him to travel to California, where he was ultimately arrested, according to the indictment.
“The exploitation of children is a serious offense that this office will fully prosecute,” said U.S. Attorney Kevin O’Connor. “Those who possess child pornography or hinder the prosecution of those who do by destroying evidence and impeding investigations will be prosecuted, particularly when the obstructionists are attorneys and officers of the court.” (Greenwich Times)

46 year old Ronald Evan Mays was found guilty of sexually molesting and sexually touching an 8 year old girl who was sitting next to him. The abuse took place aboard a South West flight from Tampa, FL to Nashville, TN.
TAMPA, Fla. (AP) — A businessman was convicted Friday in federal court of sexually touching an 8-year-old girl who was sitting next to him on an airplane.
Ronald Evan Mays, 46, was found guilty of abusive sexual contact with a child, assault and obstruction of justice. He faces up to 25 years in prison.
May’s attorney tried to claim that it was another man that was sitting in an unassigned seat that committed the abuse; however, both the 8 year old girl and separate passenger picked Mays out of a line up.
Prosecutors said Mays also used a software program to destroy files on his computer after the government had requested it. Some files were recovered and show scenes of child pornography, prosecutors said.

U.S. District Judge Lawrence Karlton restricted some of the wording that was put forth in California’s Proposition 83 that put restrictions of convicted sex offenders. Judge claims that Jessica’s Law not intended to be retroactive.
Voters passed Proposition 83 on a 70.5 percent to 29.5 percent vote in Tuesday’s election. The measure bars registered sex offenders from living within 2,000 feet of schools and parks, a requirement challenged in a lawsuit by an anonymous plaintiff convicted of a sex offense 15 years ago.
It continues to be an unbelievable concept that Judges wish to continue to protect the rights of sex offenders and pedophiles over the rights of children and victims. This country has a decision to make. It cannot be both ways. It has become obvious that sex offenders rights are protected as they gradually escalate their crimes, ruin children’s and family’s lives until they commit murder. Suddenly there is outrage. Jessica’s Law is intended to protect children in whatever manner possible. It is the judge’s law that interprets it to fit their agenda.
SACRAMENTO, Calif. (AP) — A federal judge ruled Friday that California’s ban on sex offenders living within 2,000 feet of places where children gather can’t be applied retroactively.
U.S. District Judge Lawrence Karlton said there was nothing in the so-called Jessica’s Law that specified its provisions were intended to be applied retroactively. He added that state law requires the statute apply from the date it takes effect.
More than 70 percent of voters approved the measure, Proposition 83, on Nov. 7 and it took effect the next day.
The law prohibits registered sex offenders from living within 2,000 feet of a school or park, effectively banning paroled sex offenders from many California communities. It also requires lifetime satellite tracking for some paroled sex criminals upon their release from prison.

Child molester sentenced to 800 year … now there’s a good start.
Fred Everts, 36, was convicted of molesting three boys ages 3, 9 and 11and was sentenced to 800 year in a San Jose, California court. Everts had admitted to molesting over 40 children. Many states in the US should follow this example.
Police discovered the crimes two years ago while investigating Dean Arthur Schwartzmiller, who authorities say may have molested hundreds of youngsters over decades and kept detailed logs on the children.
Schwartzmiller, 65, was sentenced in January to 152 years in prison for abusing two 12-year-old boys. He and Everts had met in prison on earlier molestation charges and eventually moved in together in San Jose.
Steve Fein, who prosecuted both men, said Everts admitted molesting about 40 children, including his 3-month-old biological son. He asked for the maximum sentence of 1,175 years to life.
Everts’ sentence was compounded under California’s three-strikes law because of two felony convictions in Oregon in 1993 for sodomy and sexual abuse on his young stepson. (AP)

William Lorenzo Page, 23, the father of Nyia Miangel Page whose body was found Sunday at an abandoned playground was charged with criminal homicide, kidnapping, false reports and simple assault.
A man angry his toddler daughter wouldn’t go to bed knocked her unconscious and left her to die outside in single-digit temperatures, police said.
The frozen body of Nyia Miangel Page, who was about to turn 2, was found Sunday at an abandoned playground about a 10-minute walk from the family’s home. Tiny footprints in the snow suggest she had gotten up and wandered around before she died, police said. (AP)
William Lorenzo Page was in jail on unrelated charges. Those charges consisted sexually abusing another child shortly before Nyia died. What a piece of human garbage this one is.
The sexual abuse charge against Page came as police investigated Nyia’s disappearance.
Police said another child in the house told investigators that sometime overnight Friday, Page entered a bedroom, covered the child’s mouth with one hand and touched the child’s genitals with the other. The child said Page then left the room, followed by Nyia, police said.

This idea has been a long time in coming and makes a lot of sense. The TSA will be partnering with the National Center for Missing & Exploited Children to distribute AMBER ALERTS at airports nationwide. The more eyes the better. This is a great and welcome idea.
TSA will distribute AMBER Alert messages through the communications system of the national Transportation Security Operations Center (TSOC). As soon as NCMEC is notified that an AMBER Alert has been issued by law enforcement, the TSOC will relay that information to FSDs at relevant airports. FSDs will receive information such as photos and descriptions of the abducted child, the suspect and vehicle. (PR Newswire)

An Amber Alert was initially issued for 10 year old Marissa Graham in Oklahoma. She was reportedly abducted by a white male approximately 35–40 years of age. Later the next day Marissa Graham was found safe in Clovis, NM getting away from her abductors vehicle at a gas station. The suspect remained at large.
The FBI has recently released some new information in the case of Marissa Graham’s abduction. The FBI is presently offering a $25,000 reward for information leading to the identification, arrest, and or conviction of the person or persons who kidnapped Marissa.
Graham was abducted about 6:30 p.m. on Jan. 18 while collecting donations for a basketball fundraiser in Texhoma and was driven to Goodwell, Okla., where the suspect stopped near a grain elevator, said FBI agent Michael Ward. “At this point, the suspect is believed to have engaged in a cell phone conversation with an unknown person … (and) inquired as to the media coverage and police response to the abduction,” Ward said. There seems to be one important change from the initial accounts of the 10 year old’s escape from her abductor. It appears that the kidnapper opened the trunk latch and released Marissa.
When the suspect drove to an Allsup’s convenience store in Clovis, Ward said the man activated the automatic latch for the vehicle’s rear door and let the girl out of the vehicle. The girl then walked into the store and notified store employees, who called police.

14 year old mother, Roselia Morente-Barrera, and her 20 month old son, Yoveni Morente-Barrera, were reported missing Thursday from a shelter. They left the San Carlos Park foster home for teen moms without permission.

File this one under it couldn’t have happened to a more deserving person. Dean Arthur Schwartzmiller was sentenced to 150 years in prison for the rape and molestation of two 12 year old boys.
Dean Arthur Schwartzmiller, 64, who also had been convicted of sexual assaults in several states over three decades, was sentenced to the maximum term on 11 felony counts of child molestation and one misdemeanor charge of child pornography possession.
Schwartzmiller represented himself during his trial last year but asked for an attorney to represent him during the sentencing phase. (AP)
It has been reported that Schwartzmiller was one of the most prolific serial rapist who may have been responsible for numerous and untold scores of child rapes.
When Schwartzmiller was arrested in June 2005, investigators found a memoir describing abuse, binders full of child pornography and 1,500 notebook pages with headings including “blond boys,” “no, but yes boys,” and “best of the best, 13 and under.”
Get a load of what this child molester and his attorney tried to pass off as a defense … “Our society doesn’t accept a man who loves boys”. Gee, no kidding!!! Earth to defense attorney, its also against the law, but I guess that is a technicality for a lawyer who represents the scum of the earth.
Schwartzmiller, who acted as his own attorney during his October trial, told jurors that he was innocent and maligned by a society that doesn’t accept men who love boys.
During his testimony, Schwartzmiller said the memoir and notebook entries were fiction.
Schwartzmiller sentenced to 150 years for child molestation
Schwartzmiller, who had at least three molestation convictions and a dozen arrests over three decades, abused many as 100 boys in eight U.S. states, Mexico and Brazil from 1969 to 2005, prosecutors said.
Although police say Schwartzmiller appears to have spent much of the past three decades years in California, he has also been arrested on child molestation charges in New York, Idaho, Oregon, Arkansas and Washington. He has lived in Nevada, Texas and Washington.
In 1984, the Idaho Supreme Court upheld a 1978 conviction for molesting two 14-year-old boys and characterized Schwartzmiller as a “repeat offender” who “uses his intelligence to take advantage of the weak and oppressed and those who are in need.”
Schwartzmiller “frequents areas where young boys may be found, befriends boys with no father figure in the home, entices them from their homes, lowers their natural inhibitions through the use of drugs and alcohol, and commits sex acts upon them,” the justices wrote.
At the time of his arrest in 2005, he was wanted in Oregon on felony sexual assault charges involving a minor. After serving prison time in Idaho for child molestation in the late 1970s, he lived in Brazil, and was extradited from there to Idaho again in the late 1980s. (Pine Bluff Commercial)

There is good new to report in the abduction of 31 year old Kimberly Walker and her four missing children: 9-year-old Jaylan, Justin, 8; Kyara, 6; and 16-month-old Kayla. All have been found safe and are well. They were found Tuesday night in a hotel. Jerry D. White, 30, was arrested.

ELKHART, Ind. – A mother and her four children were found safe Tuesday night at a motel just miles from where police said the father shot a man and abducted them three days earlier, authorities said. He was arrested as he tried to escape through an air duct.
Jerry D. White, 30, was arrested on suspicion of attempted murder and several counts of confinement, police said.
Investigators were able to trace the family to the Sleepy Hollow motel, about 6 miles from Walker’s home, in part because Walker had made three calls to relatives from a nearby pay phone saying they were safe, said Detective Sgt. Bill Wargo.
Officers knocked on the door of the motel room about 8 p.m. Tuesday and heard rumbling inside, after which Walker opened the door. (Yahoo News)
A truly tremendous job by all law enforcement to bring this to a safe ending.
